Terms and Conditions for Online Auctions


AUCTION CLOSING: The bidding closes with the first 4 items at 7 PM then closes 4 items per minute, thereafter, until the last item in catalog order.

REMOVAL: Each auction will have the date/time/location for removal.

PLEASE NOTE: You will be blocked from future bidding for items not picked up on time! If you cannot make the removal, you need to send someone on your behalf to pick up for you with their own ID and the printed invoice!

This is an ONLINE ONLY AUCTION PLEASE DO NOT BID IF YOU ARE NOT ABLE TO PICK UP YOUR ITEMS during the scheduled removal times. After the scheduled removal, items will be considered abandoned.

PAYMENT: Accepted forms of payment include Visa, MasterCard, Discover, American Express or cash.

At the conclusion of the auction you will be sent an email with a total of the items you won.

STAFF BIDDING: Please note that staff bidding is allowed in this auction, any one from the staff may bid on and purchase items for the high bid. I charge my own mother for items that she wants so the same rules apply to the staff, business is business.

SELLER BIDDING: Bidding by the seller of item(s) in this auction is NOT allowed, the seller is NOT permitted to buy back an item for the highest winning bid amount or place a bid to cover their reserve price.

All auctions are presumed to be with reserve. The starting bid is considered the reserve price, any bid at/or above the starting bid is assumed to be sufficient to cover any reserves.

Condition notation of "new/appears new": Item will appear to have never been opened. It will appear to have the original manufacturers' seal and/or shipping straps and be in unused condition. You may return the item up to 30 days from auction close with the original purchase receipt if the item is not complete or functional as long as you have not previously used it.

Condition notation of "New, Open Box": Items marked "New, Open Box" indicate that item appears to have been previously opened, but not used. You may return the item up to 30 days from auction close with the original purchase receipt if the item is not complete or functional as long as you have not previously used it.

Condition notation of "used": Items marked "used" appear to have been previously used. If possible, items will have secondary photos that display the usage. Items are tested to the best of our ability for completeness and functionality, if we missed something during testing, the item may be returned up to 30 days from auction close with original purchase receipt.

Condition notations of "parts" and/or "damaged: Items marked as either "parts" and/or "damaged" have not passed our inspection process, but have been deemed to possibly have some value to bidders. These items may not be returned and are being sold as-is, where-is.

Increasing your own bid/Bidding Errors: Please be aware that many bidders routinely increase their own bid to price an item out of reach of other bidders. You should immediately review your bids once submitted. If you mistakenly increase your own bid, place your bidder number in the bid field, or make a typo you must immediately contact our office in writing at bidretractions@gmail.com (we MUST have your request in writing) and call us DURING BUSINESS HOURS of 10am-6pm. We will not reverse bids within three hours, or after, the auction has closed, no exceptions. ***Please note that bid cancellations or retractions are at the manager's discretion only - submitting your bidding error does not guarantee that your bid can or will be deleted/retracted/cancelled.

STAGGERED CLOSING: The online auction closes 4 items per minute. This feature will close the bidding on intervals at the designated close time.

BID NOTIFICATIONS: If you have been outbid you will be notified by email until the auction begins to close. To quickly review your bids and see if you have won, you can utilize the 'review bids' feature. Items that you have been outbid on will be clearly marked.

WINNING BIDDER NOTIFICATIONS: You will be contacted by email ONLY (you are responsible for checking your email) If you feel you have won an item and have not received an email, you must notify us via our contact submission form no later than 9am the next day.

SALES TAX: Sales tax is included in your bid price. We back out the sales tax at the end of the day in order to avoid having change when making our bank deposit.

CAUTION: For demonstration purposes, assorted equipment may be joined. Do not assume a lot consists of more than one item simply because they are connected or pictured together.

CATALOG INACCURACIES: You are bidding on the described item, not the photo. Occasionally the wrong photo is displayed. Please always read the item description.

SHIPPING: Most items can be shipped at the buyers’ expense. AFTER, the auction ends you may contact us for a shipping quote. We will charge the actual non-commercial shipping rate + the cost of any shipping material. If you want to know how much it will cost to ship, you can type the item description in amazon.com or Walmart.com, look under description for size/weight of the item, then go to either UPS or the USPS website with the information and get a quote.

WARRANTY & CONDITION OF ITEMS SOLD: Unlike many online and live auction houses, we guarantee everything we sell that is not listed as "parts" or "damaged". In the event that we missed something and the item is missing parts or does not work, you may return the item for a full refund within 30 days of the auction close with the original receipt as long as you do not cuss, swear, act obnoxious, vulgar or disrespectful. NO EXCEPTIONS! We attempt to make every effort to be honest in our description and make this an enjoyable experience for everyone. When you are not certain of the condition or use of an item please bid accordingly. You are bidding on the described item, NOT the photo.

Bidders are responsible for their own removal. Any item NOT picked up by the set time will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon presentation of email receipt. Please insure that movers or anyone picking up items on your behalf have your receipt at the pickup location no items will be released without an email receipt.

IMPORTANT! Seller will have the option of reselling, removing, storing or abandoning items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items.

CHOOSE WISELY: We want everyone to get a good deal and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition or suitability for intended use, please bid accordingly.

The Overstock Shoppe LLC reserves the right to add or remove items from the auction, split or combine lots, add minimum bids or reserve prices, cancel, suspend, extend or reschedule an individual item and/or auction event, and make changes to the auction closing times or the inspection or removal times.

Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Trumbull County, Ohio.

Liability: The Overstock Shoppe LLC and Sellers(s) liability shall be limited to the refund of bidder(s) purchase price.

LIMITATIONS: The above-stated Conditions of Sale cannot be altered except in writing by The Overstock Shoppe LLC.
